AV Science, Inc. Return Policy & Conditions of Sale
The AV Science, Inc. (AVS) Return policy allows our customers to buy with confidence knowing that they may return their purchase within fifteen
(15) days for any reason, subject to the restrictions set forth below. The details of this program are as follows:
Subject to the exceptions described below, customers may return a purchase within fifteen (15) days of Receipt1 of the product. The customer must call our Product Returns department at 877-823-4452 to obtain a Return Materials Authorization (RMA) number within fifteen (15) days of Receipt. The Product Returns department is open Monday through Friday, 9am to 6pm ET. AVS does not issue RMA numbers to emailed requests.
RMA numbers will be valid for ten (10) business days after issuance. If the customer does not contact us in writing or if the tracking is not sent to the Product Returns department (see below) within that time period, the RMA will expire and the customer may no longer return or exchange the product.
1 Receipt is defined as the date a product is signed for, or delivered if no signature required, on record with the freight / shipping carrier.
Return Shipping Instructions / Shipping Charges
Freight and shipping charges are non refundable and the customer is responsible for all return shipping costs. Once the RMA number has been issued, a return packing slip will be emailed to the customer. Please include the return packing slip in the box. DO NOT WRITE ON THE OUTSIDE OF THE BOX.
Upon receipt of the return packing slip, the customer must ship the product by 3rd day delivery method, insured for the full value of the purchase.
All returns / exchanges must be in their original packaging, with all UPC codes intact, with all documentation including blank warranty card and manuals, and with all accessories. All returns and exchanges should be shipped to: AV Science, Inc. 77 Hallstead St, Suite 4 Rochester, NY 14610
Upon shipment, customers must forward tracking information to the Product Returns department by email at email@example.com or by fax to 585-340-6310. Please include the RMA number in the email / fax. The tracking information will serve as proof of the date of shipment only. The customer remains responsible for ensuring delivery to AVS, and the risk of loss or damage to the product remains on the customer until Receipt by AVS.
Exceptions to 15 Day Return Policy
3D Glasses: Due to health laws regarding sanitation issues of 3D glasses, we cannot accept any returns on 3D glasses, regardless of manufacturer. Defective glasses will be replaced with the same product. Opened 3D glasses cannot be returned at any time.
Clearance Items: All sales of clearance items are final, and no returns or exchanges may be made.
Special Order Items: Special order items may not be returned or exchanged. Special order items include, but are not limited to, screens, any product with non-standard color or design, and products that are not typically stocked by AVS.
Lamps: Lamps that have been opened or used may not be returned or exchanged.
Programming: Programming services, once rendered, are not refundable.
Projector Calibration Services: Calibration services of any kind are not refundable.
• If your projector has less than four (4) hours on the lamp, it may be returned for the full purchase price within fifteen (15) days as provided above.
• “B” Stock projectors – If your projector has less than four (4) additional hours on the lamp, it may be returned for the full purchase price within fifteen (15) days as provided above.
• Projectors with more than five (5) hours may not be returned or exchanged.
• Any sign of damage or excessive usage may result in a 15% restocking fee even on projectors with less than four (4) hours of use.
• Tampering with any of the service menu settings on a projector will void the AVS Return Policy, and no refund or exchange will be allowed.
A product is dead on arrival (DOA) if it does not power up.
If a product arrives defective or DOA, the customer must contact our Product Returns department (877-823-4452) or the customer’s Sales Representative within fifteen (15) consecutive days of Receipt of the product. At no cost to the customer, a replacement unit will be shipped and the defective or DOA product will be picked up and returned to AVS. The customer must have the product packed and ready for pick-up within 24 hours of receiving the RMA number.
A defective product is one that does not meet the manufacturer’s factory specifications.
If a defect is discovered after the fifteen (15) day period but within thirty (30) days of Receipt, the customer must contact our Customer Service team in writing, either by email to firstname.lastname@example.org or by US mail at AV Science, Inc. 77 Halstead St Suite 4, Rochester, NY 14610, and AVS will work with the manufacturer to repair and return, exchange with the same make and model item, or replace with a product of equal value as per the manufacturer’s guidelines.
Customer is financially responsible for all defective product until it is returned to AVS or manufacturer. After 30 days, the customer must contact the manufacturer directly for assistance with any defective product or other technical and service issues, should they arise. Return instructions will be provided by AVS once the RMA for the defective product has been approved.
AVS reserves the right to test any product returned/exchanged as defective or DOA. If AVS tests the product and the problem is not duplicated, the customer shall be responsible for all shipping/freight costs associated with the shipment of a replacement product and the return of the allegedly defective or DOA product. In addition, the customer shall be charged a restocking fee of 15%. Where the product was originally purchased via credit card or PayPal, the customers account will be charged for all such costs and fees. For all other purchases, the customer shall remit payment immediately upon receipt of an invoice from AVS.
B-stock, refurbished, clearance and final sale items do not qualify for defective or DOA exchanges. Customers should contact the manufacturer directly to arrange repair or exchange.
Condition of Returned Items
All merchandise must be returned in new and sellable condition. The packaging must be free of any tears, dents, holes or markings that were not originally on the box. Any such defects may result in a charge for replacement packaging. If the product shows signs of excessive use or is missing any items, AVS reserves the right to refuse the return or exchange, or charge the customer a restocking fee.
Items Damaged in Transit
If a product arrives with obvious damage, the customer should refuse the shipment. AVS strongly recommends that customers open and inspect all purchases while the delivery person is still there. If there is concealed damage, refuse the shipment. If a customer discovers shipping damage after acceptance of the delivery, the customer should contact the Product Returns department (877-823-4452) and AVS will initiate a claim with
the carrier. If AVS receives approval of the claim from the carrier, AVS will ship a replacement product at no charge to the customer.
Product Lost in Transit
Our products are shipped requiring a signature for delivery. If the customer has a release of signature on file with the freight / shipping company,
AVS will not be liable for any product that is lost or stolen.
Products sold as “new in box” include the standard manufacturer’s warranty – typically one year. Extended warranties may be available; customers should ask their sales representative or call the manufacturer for availability. Lamp warranties vary; ask a sales representative for details. B-stock, open box, clearance items and final sales may carry manufacturer warranties, please ask a sales representative for details.

THE ONLY WARRANTIES, IF ANY, BEING PROVIDED WITH RESPECT TO THE PRODUCTS ARE THOSE EXPRESS WARRANTIES PROVIDED BY THE MANUFACTURER OF THE PRODUCTS. AVS DOES NOT MAKE ANY REPRESENTATION, WARRANTY, PROMISE OR COVENANT, AS TO THE CONDITION, QUALITY, DURABILITY, CAPABILITY, FUNCTION, PERFORMANCE, OR SUITABILITY OF ANY PRODUCT, AND HEREBY DISCLAIMS, ALL OTHER WARRANTIES, STATUTORY, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, QUIET ENJOYMENT AND NONINFRINGEMENT, WHICH WARRANTIES ARE HEREBY SPECIFICALLY DISCLAIMED.
LIMITATION OF LIABILITY: AVS SHALL NOT BE LIABLE FOR EITHER SPECIFIC PERFORMANCE OR ANY LIABILITY, LOSS, OR DAMAGE ARISING OUT OF THE USE OR MISUSE OF A PRODUCT. FURTHER, AVS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES INCURRED BY ANY CUSTOMER OF AVS OR ANY THIRD PARTY, UNDER ANY THEORY OF LIABILITY, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR USE, AND INCLUDING THE COST OF PROCURING SUBSTITUTE GOODS, EVEN IF AVS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL AVS’S AGGREGATE LIABILITY FOR ANY DAMAGES, UNDER ANY THEORY OF LIABILITY, EXCEED THE PURCHASE PRICE OF THE PRODUCT GIVING RISE TO THE LIABILITY.
Credit cards & PayPal: All refunds for returned purchases made by credit card or PayPal will be credited to the same account within five (5) business days after acceptable inspection by our Product Returns department.
Cash, Checks and Wire Transfers: All refunds for non-credit card forms of payment will be made by company check mailed within ten (10) business days after acceptable inspection by our Product Returns department.
Non Sufficient Funds:
A $30 returned check fee will be assessed for any check returned by the bank as NSF (Non Sufficient Funds). The check will be re-deposited only once; if it is returned again as NSF, an additional $30 will be assessed and the customer will lose the option of paying by non-secured checks.
Future orders must be paid by cash, credit card, wire transfer or bank check. Customer will be responsible for any and all attorney’s fees and court costs should collection proceedings be initiated. No product will be shipped until restitution is made.
AVS will charge sales tax for any purchase in the states of Arizona, California, Colorado, Florida, Georgia, Illinois, Indiana, Kentucky, Maryland, Massachusetts, Michigan, New York, North Carolina, Ohio, Pennsylvania, Virginia & Washington, and may charge sales tax on any product that is manufactured in the same state as a customer resides. AVS reserves the right to collect sales tax on other sales in order to comply with any applicable Federal or state law that may be in effect. Customers are solely responsible for remitting any and all taxes due, and not charged by AVS, on their purchase based on the laws of their state of residence and the Federal Government.
The Terms and Conditions set forth above and all transactions between AVS and our customers shall be governed by the laws of the State of New York. All transactions between the customer and AVS shall be deemed to have been contracted through the AVS office in Rochester, New York. Buyer agrees that all actions concerning this Return Policy & Conditions of Sale and the product(s) shall be initiated and/or defended in a court of appropriate jurisdiction sitting in Monroe County
